Common Questions

Yes, a 28-day exchange is possible, but you will need to ensure your mortgage offer is in hand. The builder’s conveyancer will usually provide prepacked legal documentation and have standard replies to enquiries available. You will need to speak to your Conveyancer as soon as possible to advise and agree a timetable for exchange.

If you are purchasing the property with the assistance of a mortgage then your lender will require a valuation, but this is not a full survey and is for the lender’s benefit, not yours. It is always sensible to instruct your own independent survey to take place.

A contract usually provides for you to insure on exchange of contracts.

Although the contract of sale provides for 10% of the purchase price to be paid as a deposit upon exchange of contracts, sellers often agree a lower deposit. This will be a matter of negotiation by your Conveyancer. E.g. if you are purchasing the property with the assistance of a 95% mortgage then it could be negotiated for you to pay a reduced deposit of only 5% and the contract will be amended accordingly.

We will always work to drive the transaction forwards with speed and efficient, but we cannot guarantee at the outset that there will not be any delays. The common causes of delay are:

  • A mortgage application taking longer than normal to process which therefore delays the mortgage offer being produced.
  • Length of the chain involved. There could be a delay at a point in the chain which will naturally delay everyone else.
  • Searches being delayed by the Local Authority.
  • Entries revealed on search results which require further documentation or enquiries to be raised.
  • Another party in the chain not wishing to proceed as quickly as others.

If you are purchasing the property with a mortgage with the intention of letting out the property then you will need the consent of your lender to do so. If the property you are purchasing is Leasehold, the terms of the lease must be checked to ensure that letting is permitted.

The Estate Agent’s commission is usually paid on the completion date from the net proceeds of sale of the property. Your Conveyancer will usually settle the invoice on your behalf.

Once you have exchange contracts you will need to notify the utility companies and the Local Authority that you have sold the property. Similarly, if you are purchasing a property, you will need to advise the Local Authority and utility companies upon exchange.

For most properties that are registered, there are no longer any ‘deeds’ for the property as all legal documents are held electronically at the Land Registry. Any documents that are provided i.e planning permissions, guarantees, if any should be kept in a safe place as they may be required when the property is sold again.
